May 7, 2013, Bronx, New York- a man traveling on the Bronx Expressway, narrowly missed a brush with death after a piece of road debris came flying through his window earlier this week.

According to CBS New York, Anthony Murphy was driving on the Cross Bronx Expressway early Monday morning on his way to work as a bus driver when a piece of debris dropped and flew threw his front window near Jerome Ave.

Murphy explained to CBS, “It comes at you so fast. I just know that something black was coming toward my windshield. I couldn’t go nowhere; it went through.” Adding, “All I knew was that I can’t swerve and go to the side of the road; what I was trained to do.”

When Murphy spoke to CBS later Monday evening he was still shaken, “The whole windshield shattered on me. I have glass everywhere. I have a couple of cuts.” He said, “I’m happy to be alive.”

First responders, who took a while to get to Murphy because of numerous collisions, initially believed the debris was a metal rod from an overpass, but authorities said later the debris had to come from some sort of truck.

Murphy’s experience is not unique it happens often, and although not all accidents caused by road debris are devastating, these accidents can leave people seriously injured or mortally wounded, and can cause extensive and costly property damage.

State and federal governments are responsible for keeping highways maintained and clear of debris, but pursuing either for compensation is difficult. The accident victim is faced with the burden of trying to prove that local or federal authorities were aware of obstructions in the roadway, and failed to clear it away in a reasonable period of time, thus causing a dangerous collision.

Frequently, these road debris accidents occur when it is difficult to determine who is liable for the damage. When this happens, the injury victims or families of the deceased will have to rely on a settlement from their insurance company to cover medical expenses. Accident victims should always speak to a personal injury attorney before agreeing to any settlement amount. An attorney knows the true value of your injuries and suffering, they won’t allow you to settle for less than you deserve.

There are rare occasions when an injury victim is able to clearly identify the vehicle the road debris originated from. If the accident victim is fortunate enough to see the obstruction coming from a vehicle and was able to get the license plate number they are able to pursue that driver for any resulting damages.

Accident-related medical bills can be overwhelming, and many victims find they may lose weeks or months out of work, and some injury victims will never be able to work again or support themselves. These victims shouldn’t have to fret over how they are going to pay their bills or put food on the table, with the guidance of a Bronx accident attorney they won’t have to.

Studies have shown that accident victims who retain an attorney receive more compensation than those who forgo the assistance of personal injury attorney. If you have been injured in the Bronx and want the best attorney contact the office of Seth Goldstein to discuss your case.

April, 25, 2013, Bronx, NY- Even though people are aware that distracted driving is dangerous to themselves and others, many people still use their cell phones to talk text or email while they are behind the wheel a recent study from the National Highway Traffic Safety Administration.

The NHTSA and other safety advocate groups have spent the month of April trying to hammer the reality that distracted driving is dangerous and deadly into the motorists’ heads. But that point isn’t getting through to drivers

Speed and intoxicated driven happen to be two of the primary causes of traffic accidents, but distracted driving is becoming a dangerous problem, especially since almost every driver has a cell phone and/ or in-car entertainment systems. After analyzing data from three different distracted driving studies, the NHTSA estimates that during day hours 660,000 drivers are using their cell phones and smart phones to talk, text, or email.

Many of these drivers are aware that they can cause an accident and kill or harm others, but they are undeterred, at least 50 percent of all drivers admit to taking a phone a call or continuing a phone call while they are operating a vehicle.

Texting is just as bad if not worse. Drivers who text are 23 percent more likely to get into a traffic collision than drivers who don’t.

“Many drivers see distracted driving as risky when other drivers do it, but do not recognize how their own driving deteriorates,” said NHTSA Administrator David Strickland in a statement. “I urge all motorists to use common sense and keep their attention focused solely on the task of safely driving.”

To combat distracted driving and all the unnecessary deaths and injuries, the NHTSA has made recommendations for automakers that would cut down on distractions caused by in-car entertainment systems and has plans to issue guidelines for cell and smart phone manufacturers in the future.

Not only do drivers fail to heed the warnings of safety advocates, but they also disobey the law. In the Bronx and the rest of the state, it is illegal for a motorist to use a mobile or smart phone while driving, but a potential $200 fine and three points on their driver’s license is not stopping these drivers from talking and texting behind the wheel.

If these drivers are unfortunate enough to cause a fatal or injurious accident, the victims will have just cause to expect the distracted driver will cover their medical expenses and other damages.

Settlements from negligent drivers are often handled by their insurer, but victims should be aware that hiring a Bronx injury attorney will help them get a larger settlement amount; two to three times more than injury victims who don’t have legal representation. Injury attorneys know what your injuries or actually worth and won’t allow an insurer or negligent to shortchange them.

No case is too big or too small so contact Mr. Goldstein’s office to set up a consultation.

April, 15, 2013, Bronx, NY- A crowded shopping area in the South Bronx became an accident scene as an elderly driver lost control of their vehicle on April 7th and plowed into a group of pedestrians in an area known as the Hub.

Authorities say that an 85 year-old man lost control of his vehicle on East 149th Street and Bergen Ave.

One witness told the New York Post that the driver hit a car, and then jumped the curb slamming into a group of five pedestrians, finally crashing into a building. The impact flung the vehicle back into East 149th Street.

One witness described what they saw to the Post, “The car was coming. He tried to stop, but the brakes didn’t stop. He swerved,” adding, “The car swerved and hit a Con Ed truck. Like a pinball machine, he bounced back and went into the building. There was a hole in the building.”

One man, who pushed his wife out of the way of the oncoming vehicle, suffered a broken leg. The other three pedestrians were taken to hospital with serious but non-life threatening injuries, the Gothamist reported.

Employees of the building that was struck told NY1 that the outside of the building was damaged.

Even a minor injury can adversely affect a person’s life; they may incur thousands of dollars in medical bills. The recovery process can take months and even years if the injuries are severe enough. Some accident victims never recover from their injuries and some unfortunately lose their lives.

Medical bills aren’t the only financial problems that accident victims face. They have to figure out how they will pay their rent, utilities and buy food and other necessities while they are recovering. This can be problematic if the injury victims must stay out of work for weeks or months.

Traffic collisions, like this one, also cause a great deal of property damage. Repairing a damaged car or in this case can a building can be costly.

Soon after an accident, the victim will be contacted by the negligent driver’s insurance company. They will want you to settle the case quickly and for much less than the injured person is eligible for or deserves. Don’t be fooled into accepting a settlement before you have talked to an attorney to determine the true value of your injuries.

Whether you decide to accept a settlement or pursue the negligent driver in court, the representation of a Bronx attorney can assure you are generously compensated for your suffering.

A serious injury can shatter a person’s life and they need someone to help the put the pieces back together. Bronx injury attorney Seth Goldstein can’t take away your pain, but he can make certain you will never have to worry about how you are going to pay the bills. Once the injury victim is able they should contact Mr. Goldstein’s office so he can evaluate your case and maximize your final settlement.

April, 11, 2013, Bronx, NY- A Bronx NYPD officer caused a traffic accident without injury and fled the scene with a passenger to hide from authorities in a nearby home.

Officer Kelly Hughes, 24, did not face formal charges but agreed to enter a rehab program after she overturned her vehicle on Revere Ave. Hughes and her passenger ran from the scene leaving her vehicle sitting in the road.

Police told the New York Daily News that Hughes flipped her Nissan after slamming into a parked Mitsubishi SUV around 4 a.m. last Thursday.

Michael Londonio, the Bronx resident who owned the Mitsubishi told the Daily News, “We looked outside, and we saw a car upside down. My car was banged up pretty good.”

Police say after the crash, both Hughes and her passenger took off and approached an area resident requesting a place to hide.

Hughes was eventually found by police at her home in Edgewater Park, which is about a mile away from the accident scene.

One source told the Daily News Hughes and her passenger were “both hammered and couldn’t remember anything.”

Hughes, who joined the NYPD in January of 2010, has been suspended and police said she won’t face any criminal charges.

Hughes may not be facing criminal charges, but she will be responsible for the damage she caused to the Londonio’s Mitsubishi. She’s fortunate that no one was seriously injured or killed because she was driving drunk.

Last month, the New York City Department of Transportation released data which showed that fatal accidents across the city increased from 245 in 2011 to 274 in 2012. While speeding was a factor in the majority of those fatal accidents, drunk driving also contributes to a number of those fatal accidents.

According the National Highway Traffic Safety Administration close to one-third of all fatal accidents nationwide are caused by drivers who are under the influence of the drugs or alcohol.

Each state has different penalties for DUI manslaughter but offenders can expect to get a jail sentence ranging from 3 years to 10 years per person killed. Though the penalties

Aside from the criminal ramifications of a fatal DUI accident, the negligent driver can also face a civil lawsuit from the victim’s family. Under New York statutes wrongful death victims are eligible from monetary damages which includes funeral and medical expenses, loss of parental guidance, loss of financial support and lost services provided by the deceased. Victims can also receive compensation for their emotional anguish.

Those who wish to file a wrongful death lawsuit should act quickly and contact Bronx injury attorney Seth Goldstein as soon as they are able. It’s crucial to act quickly because the statute of limitations on these types of the lawsuits expires two years after the date of the accident victim dies.

Acting quickly also gives attorney Seth Goldstein adequate time to gather evidence, review medical records and work on building a strong case. If you have lost a loved one to the careless actions of another, set up a consultation with Mr. Goldstein’s office to evaluate your case.

April, 4, 2013, Bronx, NY- Two pedestrians on Bruckner Boulevard in the Mott Haven area of the Bronx were killed Monday when they were struck down by a hit-and-run driver, causing outrage among residents who say the police need to ramp up their efforts to keep the streets safe.

At 4:30 a.m. Monday morning a man and his nephew were crossing Bruckner Ave. when a truck struck then killing them instantly. Police told DNAinfo.com that both of the men were intoxicated at the time of the crash.

The truck driver fled the scene and police are asking that anyone who has information about the accident to come forward.

The DNAinfo.com story said that the 138th Street district, where the most recent pedestrian accident occurred has been the scene of at least three fatal pedestrian accidents since the beginning of the year. One of those incidents involved a 69 year-old man who was ran over by a speeding truck.

Local residents are frustrated and outraged over the string if fatal accidents, blaming police for what they consider lax enforcement of traffic laws. But Deputy Inspector Christopher McCormack assured Bronx residents that the 40th Precinct takes the enforcement of traffic laws seriously do what they can to curtail speeding along the crowded and heavily traveled 138th Street business corridor.

Recent DOT data showed that speeding was the primary cause of fatal accidents in New York for 2012, accounting for 30 percent of traffic deaths. In light of these statistics, advocates for pedestrians and cyclists say that red light cameras would be an effective to discourage speeding drivers.

Juan Martinez, general counsel for Transportation Alternatives, an advocacy group, pointed out that had there been a camera at the intersection where the two men were killed, police would be more easily able to locate the hit-and-run truck driver.

The frustration of Bronx residents is echoed in other areas of Manhattan and adjacent New York boroughs. While the majority of fatal traffic accidents involve one or more vehicles, pedestrian accidents should be taken seriously and any steps that can be taken to prevent accidents of any kind should be considered, but it won’t prevent all unnecessary injuries.

Fatal or serious injuries which are the result of hit-and-run driver present a series of challenges for the victims. Because in many of these cases, police are unable to locate the negligent driver, the victim must rely on their own insurer to cover their injuries.

While it is not the case with all insurance , the majority often want to settle accident claims for significantly less than the injury victim is entitled to. Whether you are trying to collect an injury claim from your insurance company or from a negligent driver’s insurance company it is in your best interest to consult with a Bronx injury attorney to ensure you receive a financial settlement that completely covers your medical expenses and property damage along with your physical and emotional suffering.

If you’ve been hurt by a careless party don’t delay and contact Bronx injury attorney Seth Goldstein immediately to begin evaluating your case. As an attorney who is devoted to his clients, Mr. Goldstein can negotiate a settlement worth thousands if not millions.

The young man, Luis Carmarillo, 18, had only been working at the company for a few weeks his family said when, on March 16th he was killed. According to the New York Daily News, Carmarillo was working near the rear of the truck when the compactor came down on his chest; the truck’s hydraulic system continued to press against Carmarillo’s chest, crushing him to death, police said.

Tony Lima who was working nearby told the Daily News, “The guy got squashed between the pay loader and the truck.”

When emergency personnel arrived on the scene Camarillo was unconscious; he was rushed to Long Island College Hospital where he was pronounced dead.

As is standard procedure in these types of occurrences, OSHA arrived at site to determine if any health or safety procedures were violated. The NYPD also conducted their own investigation into the accident and said they would review surveillance video to see how the events transpired.

Camarillo’s relatives said he was happy to be working and the job kept him out of trouble. Lucero Ariza, Carmarillo’s cousin told the Daily News, “His mother is devastated. The pain of a mother has no words. That was her only son.”

It’s a sad fact, but millions of people are injured on the job each year. According to 2011 data from the Bureau of Labor Statistics, 2,986,500 people were injured on the job, equating to 117 injuries for every 10,000 workers.

Many workplace accidents are simple errors, wet floors, obstructions in the worker’s path, which most commonly result in slip and fall accidents. Employee inattention can also play a large role in many workplace accidents, as a result most employers and their insurance companies require the injured employee pass a drug test before they will give them worker’s comp.

Of the overall, accidental injuries, 900,000 workers sustained injuries that required them to take time off of work, losing an average of 8 days. Injuries which occur on the job are typically covered by the worker’s compensation, which will pay medical expenses and lost wages.

In workplaces where employees are required to work with heavy equipment such, as a recycling plant or factory, that equipment must be properly maintained to ensure the safety of the operator. Also, employers have a responsibility to provide adequate training to their employees to avert accidents. If an employer has failed in their duty to maintain their equipment and it causes injury or death to an employee they can be held financially responsible for those injuries.

When an employee is killed or permanently disabled in a workplace accident, they and their families will suffer, physically, mentally and financially. Medical bills, lost wages, funeral expenses all present a challenge to accident victims, they deserve the assurance that they will be taken care of by the entity that caused their injuries. They need the help of Bronx injury attorney Seth Goldstein who has centered his practice on providing legal assistance to accident victims and their families with injury or wrongful death claims.

You could be eligible for a generous settlement, but first need to contact Mr. Goldstein’s office to set up a consultation to see if you have a strong case and how much compensation you may be entitled to.

March, 25, 2013, Bronx, NY- It appears that the streets of the Bronx and the rest of New York City are becoming more dangerous. And the blame lies in the frenetic pace at which drivers in the city travel. New data from the state Department of Transportation shows that fatal accidents involving speeding drivers increased by 65 percent.

In 2011, 49 people were killed by speeding drivers, but in 2012 that number increase to 82, a significant rise. According to the New York Daily News, speeding fatalities accounted for 30 percent of all traffic fatalities and the majority of those victims are pedestrians.

Hit-and-run accidents increased by 30 percent, according to the DOT data. Hit-and run accidents have become such an issue in the Bronx and other boroughs that the Bronx legislature passed news laws to increase the penalties for drivers who cause hit-and- run accidents.

A map accompanying the data shows that 75 percent of drivers were speeding within a quarter of a mile of a school.

The data reveals a striking trend and to City DOT Commissioner Janette Sadik-Khan it indicates that red-light cameras may be a feasible solution for the city’s speeding problem, and legislators are currently debating a pilot program with the backing of Mayor Bloomberg to add red-light cameras to 20 school districts throughout the city, according to the Daily News.

“Too many people still think they can pull a fast one — that nobody is looking,” Sadik-Khan told the Daily News. “These are preventable tragedies.”

NYPD Commissioner Raymond Kelley approved of the plan to add additional red-light cameras, according to the Daily News, adding that he doesn’t have the resources to put a patrol officer on every corner.

Red-light cameras have been controversial in New York. Last December, three people filed a class-action lawsuit against the city alleging that red light cameras in one area were timed shorter than the federal dictates, resulting in what the plaintiffs felt like were unjustified tickets, presumably to generate more revenue for the city.

The results are out on whether the cameras prevent accidents or whether they cause more accident. Though they may slow speeding drivers down, data from the New Jersey DOT showed that rear-end accidents at dozens of intersections with red-light cameras, though incidents of speeding were reduced.

Bronx injury attorney Seth Goldstein understands how devastated a family feels after they lose a loved one in a traffic accident. There are so many different things a grieving family must deal with when someone is killed in an accident.

The medical bills alone add an additional burden to an already grieving family. They may not want to think about the practical things like how they are going to pay medical bills, funeral expenses. If the deceased happens to be a primary provider for a family, their financial problems will begin to mount. No family should have to struggle because of someone else’s negligence.

A family has every right to make the negligent party pay for the harm they have caused them. Traffic accident victims need the help of Bronx injury attorney Seth Goldstein to guide them through the process of seeking compensation for an injury or wrongful death.

March 22, 2013, Bronx, NY- A Bronx woman suffered critical injuries on Wednesday when she was struck by three different vehicles and now police are diligently searching for two drivers who left the scene.

The accident took place on Friday March 8th in the Foxhurst section of the Bronx right before 9 p.m. The woman, who has not been identified, was attempting to cross Westchester Ave. at Faile Street when a dark-colored sedan traveling westbound struck her, CBS reported.

The woman then hit her head on a second car, a 2011 Mercedes. As she was lying on the ground a third vehicle possibly a 2002 Dodge Durango traveling eastbound hit her again continued driving.

The only driver who stayed behind to help the woman was the driver of the Mercedes. The two drivers who hit her callously drove away without even making sure she was okay.

CBS reported that the woman was taken to Lincoln Medical and Mental Health Center with critical injuries about her body.

Police are hoping eyewitnesses will come forward with any clues that can help them identify the driver, by calling their tip line at 1-800-577-TIPS or log onto their crime stoppers website.

Critical injuries generally mean the victim will face a long road to recovery. While medical costs will make up the bulk of bills, they also have to figure out a way to cover their everyday living expenses such as rent, utilities and groceries. An accidental injury can easily leave a person with tens to hundreds of thousands dollars’ worth of debt, all caused by another person’s carelessness.

The woman hit in this accident was lucky to not lose her life, but many victims are killed. The costs of a wrongful death are immeasurable. While the family of the deceased will have to deal with medical bills, they also must bury their loved one and deal with their grief and anger. When a person files a wrongful death suit they are entitled to a settlement that not only covers their physical suffering but also their emotional suffering.

Hit-and- run accidents are far too common, especially in a large city like New York, despite the fact that they have serious criminal penalties, which can be much worse than if the driver had stayed on the scene. These are very problematic accidents for the victims; because the driver took off and may never be identified they cannot sue the individual for compensation. Instead they must wrangle with their own insurance company to cover their medical bills and this often requires the help of an injury attorney to assure they obtain fair compensation.

If the hit and run driver is located, the victim or victims can and should pursue that driver for all of their accident related costs.

The most assured way to get a more than adequate settlement is to retain an attorney that specializes in personal injury and wrongful death cases. Bronx attorney Seth Goldstein has worked with accident victims for well over two decades. Through tenacity and devotion Mr. Goldstein has one large settlements for the victims he has represented.

March, 14, 2013, Bronx, NY- Accidents in a big city are common, but not every accident in New York or in the Bronx is as thoroughly investigated as thoroughly they should be.

March, 14, 2013, Bronx, NY- Accidents in a big city are common, but not every accident in New York or in the Bronx is as thoroughly investigated as thoroughly they should be. The NYPD is aiming to change that by overhauling their Accident Investigation division.

In the past, accidents were only investigated by the special division if first responders felt it would result in a fatality or “likely” to be fatal. Under the changes, the Accident Investigation squad will be dispatched to accidents that involve critical injuries instead.

NYPD commissioner Raymond E. Kelley sent a letter to the City Council detailing the new protocol, according to the New York Times. In the letter Kelley said accident investigators would be called to the scene “when there has been a critical injury or when a Police Department duty captain believes the extent of the injuries and/or unique circumstances of a collision warrant such action.”

In addition to policy changes, Kelley said the Accident Investigation Squad will be re-named the Collision Investigation Squad. Kelley feels it important to make that distinction, “In the past, the term ‘accident’ has sometimes given the inaccurate impression or connotation that there is no fault or liability associated with a specific event,” he wrote, according to the New York Times.

The NYPD also plans to increase the size of the investigation squad and amend their Patrol Guide.

This policy change will help with criminal investigations where prosecutors require more detailed accident reports to build strong cases. It will also be beneficial to traffic engineers who can use the data collected from the reports when designing new streets.

The NYPD came under fire from the City Council and safety advocated who criticized the NYPD’s handling of traffic collisions. According to Streetsblog, out of 155 traffic fatalities in 2012, only a handful of those negligent drivers have actually been charged.

The change comes in the wake of several high-profile traffic accidents. The most recent accident that received nationwide attention involved a young Jewish couple, who were killed after a speeding driver slammed into their livery can as they were making their way to the hospital. The woman was pregnant and emergency crews performed an emergency C-section to save her unborn child, who unfortunately died a couple of days later.

Not only will these policy changes affect criminal cases but it will also affect civil suits. One of the major challenges and crucial elements of a personal injury lawsuit is determining who is at fault or liable for injuries or death that result from a traffic accident. A thorough investigation can help a Bronx personal injury attorney build a stronger case which will in turn allow the victim to obtain a fair settlement for their pain and suffering.

If you are a Bronx resident and have been injured in a traffic collision you need someone to advocate for you in court. Personal injury attorney Seth Goldstein has been serving accident victims in the Bronx for over two decades winning a number of substantial settlements on behalf of him clients.

March, 6,2013, Bronx, NY- A young New York couple, about to have their first child, was violently killed earlier this week by a speeding driver in the Williamsburg area of Brooklyn.

Raizy and Nachman Glauber, both 21, were rushing to the hospital around midnight Sunday night because Raizy could no longer feel the baby; she was 24 weeks pregnant, according to NBC News.

The Glauber’s had to catch a cab which was racing the couple through a Williamsburg neighborhood when they were broadsided by a BMW.

Police said the livery cab was traveling west on Wilson Street when the BMW traveling north on Kent Ave. slammed into the driver’s side of the cab.

The impact of the crash threw Raizy out of the car onto the roadway under a parked tractor-trailer. First responders performed an emergency caesarean section on her at the scene to save the infant.

Nachman and the taxi driver were trapped in the cab but emergency crews were able to extricate the two men by cutting off the roof.

Both of the Glaubers were pronounced dead upon their arrival at Bellevue Hospita; their cause of death was blunt force trauma. Their child, who was two months premature initially survived, but died just two days later. A spokesperson for the city’s medical examiner, Ellen Borakove, said the infant’s cause of was “extreme prematurity due to maternal blunt force injuries,” according to the Daily Mail.

The cab driver Pedro Nunez Delacruz, 32, was taken to a local hospital but did not sustain any injuries.

The two occupants of the BMW fled the scene immediately after impact. Police later discovered that the car was registered to Takia Walker, 29, of the Bronx, but she was not driving at the time.

The collision occurred at an intersection and police are uncertain if the cab driver stopped at the sign but they suspect that Acevedo was speeding, traveling at close to 60 mph.

The driver, 44 year-old Julio Acevedo is still out free, but said Tuesday he was ready to turn himself in. Speaking with the New York Daily New via phone, Acevedo said, “My heart goes out to them. I didn’t know they died until I saw it on the news.”

Authorities discovered that Acevedo spent time in prison in the late 80s for the murder of one of his associates. He was also stopped two weeks prior to the accident for drunk driving but police didn’t charge him in that incident.

Leaders from the tightknit Orthodox Jewish community the Glauber’s belonged to are demanding Acevedo be charged with the three deaths.

This unfortunate accident demonstrates the dangers of speeding and failing to obey traffic laws. Hundreds of people lose their lives or are seriously injured by negligent drivers in the Bronx.

Fatal and injurious accidents not only have an emotional toll, but they take a financial toll as well. Those who are fortunate enough survive will struggle with mounting medical bills while the families of the deceased must grapple with their grief along with burial costs.

Victims of traffic accidents need a legal expert on their side. Bronx injury attorney Seth Goldstein has helped many families obtain just settlements from careless drivers who caused them undue pain and suffering.
